Airline Employees Can Spread Swine Flue.
2009-09-20 07:38:00
Airline employees who report to work ill are more likely than sick passengers to spread infections such as the H1N1 swine flu virus aboard airplanes, with low-paid workers posing the greatest danger, a U.S. government expert said on Thursday.Dr. Michael Bell, an expert on infectious disease with the U.S. Centers for Disease Control and Prevention, said flight attendants and other employees who move through aircraft can leave germs on any number of surfaces, while sick passengers could be more likely to remain stationary. But the greatest threat could come from a low-paid airline contractors, such as cleaners, if slim wages and poor benefits make it difficult for them to take a sick day.http://workfromhome.blog.da-da.net
Employees Say K Mart Secretly Taped Them
2009-09-16 00:05:00
Two K Mart employees sued the store today alleging that they were discharged in retaliation for complaining of privacy invasion after being secretly videotaped. According to the complaint, plaintiffs Ewa and Andrzej Maliszewski were maintenance workers at the Bloomingdale, Illinois K Mart store where their duties included emptying the garbage.  The complaint states that they noticed several discarded videotapes while emptying the garbage, watched the tapes and observed their changing area and the staff-only locker room area among the areas videotaped. The complaint further states that they complained about this to their supervisor and their supervisor was then relocated and the plaintiffs were discharged. Read the complaint after the jump....

Guest Author – Alok Kejriwal – CEO Games2win.com In an increasingly alarming rate, I have begun to receive a panic stricken call from close friends who have been cheated of their esop/ equity/promised /founder shares in start up’s and VC funded companies. This is what is I keep hearing: * There was no paper work in place while I was there, and when I left * The CFO kept changing * I just received a letter stating that I have shares – nothing else was given to me * I was told that the company is incorporated in Mauritius and you have shares of an Indian company * Oops – once you left, your shares ‘expired’ * Don’t worry – when the company gets sold, you will be taken care off All this is ‘cockroach’ s**t. I say cockroach s**t coz even bull s**t is usable and hence valuable. Start up companies typically in the Internet space lure mainstream professionals to join their rocky, unheard of, highly risky and usually doomed to fail venture on 2 promises: * Be...

Western Companies Are Frittering Away China Employees. Or Not.
2009-06-12 07:02:00
Fascinating article at Access Asia on how Western companies are, at the exact worst time, cutting back on their employees in China. The article, "Are Foreign Brands in China About to Give It All Away??" says that many Western companies, run out of places like London and New York, are cutting back on their China operations so as to preserve cash and save money at home: By and large, in most sectors of the retail business, they had the locals on the run both as brands and retailers. Then last year’s financial crash. Since then two mantras have surfaced – the West is in freefall; China is surprisingly robust. Our sales are declining in the West; growth is still apparent in China. Good news then for those teams in China who did all the hard work over the last decade? Eeeerrr, no. Head offices from London to Paris to New York and back again panicked – big time. Cuts were demanded; cost savings had to be found – redundancies implemented. And it seems a sort of warped, nonsensic...

Wanna Get Sued In China? Your Ex-Employees Can Help. Part II, The Corpora
2009-04-25 17:53:00
I should have waited a couple of days. The day before yesterday, I did a post on foreign employees getting sued in China by their ex-employees, entitled, "Wanna Get Sued In China? Your Ex-Employees Can Help." Today, Corporate Counsel Magazine came out with a related article, in which I am quoted. The article is entitled, "Companies Considering Layoffs in China Must Coordinate With Government." It is written by Anthony Lin, an attorney and Chief Asia Correspondent at Incisive Media. The article does a great job describing the topsy-turvy labor situation in China these days. The article starts out by setting the stage regarding the Chinese government's somewhat contradictory messages: Beijing is doing what it can to stanch the loss of jobs by downplaying some aspects of the new labor law and emphasizing others. Even before the economic downturn hit, companies complained that they would have to get rid of employees because the statute's social welfare provisions were a burden....
Wanna Get Sued In China? Your Ex-Employees Can Help.
2009-04-24 07:47:00
China Daily (h/t to my friend Brian over at China Challenges) just came out with an article headlined, "Cases soar as workers seek redress." The article gives facts behind what many of us already knew: "the number of labor disputes heard by courts has skyrocketed this year." I knew it because my firm's handling of such matters has probably just about doubled in just the last three months. According to the numbers, employee cases have increased by 59 percent over last year. The article rightly ascribes this increase to three things: 1) the economic downturn; 2) "Ever since the implementation of the Labor Contract Law in January 2008, workers have become more aware of their rights and the legal avenues available to safeguard them:" and 3) A reduction of costs for such suits to at most 10 yuan. We are finding that most of these cases arise from one (or more of the following): -- Firing of an employee for a reason not explicitly mentioned in the employer manual or not having a...

How To Treat Your China Employees. I Dunno.
2008-11-27 07:27:00
Interesting article by James Hudson over at China Success Stories. Article is entitled, "Want Committed Employees? Learn to Trust Them." Its thesis is that if you want your Chinese employee to work hard for the company, like the company, and do what he or she can for the company, you, as the company, must show real faith in your employee. And this faith includes trusting your employee to handle responsibilities and to give them the freedom they need to succeed. In the US law firm context, I 100% agree. This totally encapsulates my management philosophy, which is essentially that the key is hiring good people and then letting them go. The employee I have to monitor is an employee I do not want. Just get the job done. But, is this the right employer philosophy for China? For all businesses in China? For some businesses in China? I do not know the answers to these questions because the closest I have come to managing Chinese employees is managing Chinese lawyers whom I hire ...

Bank Employees become Phish Bait?
2008-09-22 02:00:00
What a week it was in the financial markets! With Lehman Brothers filing for bankruptcy, and Barclays subsequently buying up some of the assets; with Merrill Lynch finding a safe harbour at Bank Of America; and then, closer to home (for me at least) the merger of two of the biggest UK retail banks, HBOS and LloydsTSB. During this coming period, it is a reasonably safe bet that we may be in for a flurry of phishing attacks targeting the customers of these institutions using ruses like share “windfalls” and the like to tempt individuals into disclosing their credentials. However, in this blog, that’s not what I want to talk about. The implications for the employees of these organisations are, of course, also huge, and the degree of uncertainty and change that will ensue for a period of time will provide ample opportunity for the criminal fraternity to exploit....

Do You Know How Many China Employees You Have? I'll Raise You One.
2008-09-10 09:31:00
The other day I was searching for an email from a client named "Joe" and I came across another Joe from whom I had not heard in quite a while. So I shot the other Joe an email to ask him how his China business was going and he replied to me today by saying he was operating it in "stealth" mode but that it was going well. I immediately went into lawyer mode and told him that if he was using independent contractors in China, he was looking for trouble. I then told him how my firm has been working on a whole slew of cases for foreign companies in China who are being sued for various benefits (like an employee termination package) from people that were never employees. I went on to say that in most instances, China's labor officials are siding with the putative employees against the foreign companies and our role has mostly been to negotiate a settlement with the "employees," oftentimes by hinting that our client is so tired of this sort of thing they are thinking of leaving Ch...
Petroecuador Employees Fight Over Occidential Petroleum's Left Over Luxury
2008-09-09 21:19:00
If one needs any evidence of how divided Ecuador's class culture really is, and of how this still-poor country (even with its oil industry) has so little that its citizens scrap for everything, we have this report of Petroecuador employees actually coming to blows over luxury cars left behind after the state forced that American oil company out of the country. Now, the resulting "wake" has improved the oil sector, if not the messy politics that defines it in this country. Now, Petroecuador controls 50 percent of all oil export production in Ecuador. And while Occidental has approached the Bush Administration for help in re-acquiring the assets seized by Ecuador, the nation's representatives are taking a hard line stance, not allowing a "an arrogant, portentous transnational that doesn?t respect Ecuadoran laws to harm our country,? according to Ecuadorian president Rafael Correa.

What kind of employees for your small business?
2008-05-29 21:47:00
I have something that really bothers me lately. What kind of employees do you really want in your small business? Usually if we are talking about a bigger business, it’s better to have more types, even if you consider them individually they are not the very optimum. I mean yeah, you want the best sales people, but you might just want one that can’t sell well in general, but has the luck or ability to sign just one huge contract a year. Or yes, you want the best programmers in the World, but you might want lighter ones to deal with your site. Anyway, there are several types of employees you might want to have. I’m listing below the ones that comes first to my mind: the rookie. Good for tasks that are very repetitive or just plain operational the YUPPIE. Usually the best if you have an interesting business with great growth potential. They just want to grow together with you. They leave you the moment they have a better opportunity the seasoned professional. Good ex...
A Company Where New Employees Are Paid To Quit
2008-05-29 18:51:00
The title of the blog seems awkward! Doesn't it? You would think why the hell on this earth would a company want to pay its new employees to leave when majority of the companies in the world are trying to find new ways to find employee turnover?? There are big costs involved in the employee hiring process!! And not only the hiring process but the process to train the employees and induct them on their new jobs also costs money!! Then why... ??But hold on this title is correct and what you are reading is also correct. There is a company on this earth which, after providing a four weeks training to its new employees, pays for all the hours they have worked in the company and actually makes an offer to take $1000, over and above the salary, and leave the company. The company's name is Zappos!!Most of us know, Zappos sells shoes?lots of them?over the Internet. This is a highly profitable company and expects to reach a $1 billion mark for sales. The reason for its success is first of a...
