Stop Cyber Bullies: Vague Cyberbullying Laws Aren?t Good Enough
2009-09-13 22:54:00 According to an editorial in the New York Times, ?Vague Cyberbullying Law,? ?Lori Drew acted grotesquely if, as prosecutors charged, she went online and bullied her daughter?s classmate, a 13-year-old girl who ended up committing suicide. A federal court was right, however, to throw out her misdemeanor convictions recently. The crimes she was found guilty ...
China's Labor Laws. Find Me That Company.
2009-08-13 12:12:00 Spoke with a reporter last week regarding China's labor laws. The conversation went sorta like this: Reporter: I want your views on how enforcement of China's labor laws is holding up despite the economic downturn. I am also wondering how representative are the stories we've all heard of one bad-egg employee winning a huge lawsuit against a foreign company that is basically in full compliance with the labor laws, with every other employee running to join in. My Response: All I can tell you is what we are seeing as one small law firm that represents exclusively foreign companies doing business in China. 1. I am definitely "feeling" a loosening of labor law enforcement by Chinese government officials and even employees. This starting happening when the economy turned and it really has not changed much despite press reports of China's economy holding up well. Having a job seems to be taking greater precedence and, with that, comes a concomitant decre...

China's Business Laws. Ignore Them At Your Peril.
2009-08-08 08:53:00 Very interesting and very thoughtful post up over at Think China, entitled, "Are rules meant to be broken?" The theme of the post is that one needs to learn to "tiptoe through the gray areas of China law." I disagree. Think China has this to say: There are many rules and regulations in China that are ignored systematically. One of the hardest things for an outsider to master is the art of tiptoeing through the gray area. If you use the western interpretation of the law, you will find PRC laws paralyzing – if you are going to be a boyscout about it, you will not be able to get anything done. * * * * The Chinese legal system is more similar to parenting. Just because other kids have an iphone doesn’t mean you can have it too. When I said no more TV ever, I really meant no more TV until I change my mind. When I said you’re grounded for life, you can of course go to school… and after school activities, and if you behave well, I won’t say a word when y...

he 4 SEO Laws You Must Know to Generate Massive Traffic & Succeed at Intern
2009-05-12 16:32:00 No matter how many times these internet marketing gurus try and spin their stuff, it's almost always the same. The core SEO techniques have been the same for a while and will continue to remain the same for some time to come. I am no internet marketing guru... My expertise lies in fitness, yet I have made a presence on the web with minimal effort and I'm going to show you how to do the same. But don't for a moment think that I never got suckered into those lame SEO products, because I have. Most have been garbage and a complete waste of time, and if they weren't garbage, they were a total re-hash of some other product. I haven't come across new and relevant information about SEO, & traffic generation in quite some time... So why should you continue reading this article?Because eventually what I came to realize is that there are a few fundamental PRINCIPALS... Which if followed, will result in massive success. In fact, I should call them "laws" because no SEO technique, traf...

2009-05-05 04:02:00 The more I think about the Vermont legislature’s vote to recognize same-sex marriages in the Green Mountain State, the better the result seems. Urge Your Legislators to Vote NO on Crazy Ass Laws like SB956 and PCB-EDCA
2009-04-20 22:44:00 So, Sansom was indicted. Finally. Good news, to be sure, but what are his colleagues up to? How ’bout this… These bills (SB 956 and EDCA8) would strip voting rights away from thousands of otherwise eligible Floridians and forbid anyone from helping voters who are being denied their right to vote. We are already the laughing stock of the nation, so let’s send an URGENT message to Gov. Crist and House Speaker Cretul & Senate President Atwater. The three stooges. Or not. Let them decide. Tell them to stand up to this political power grab that will only make it more difficult to vote in Florida. When thinking about recent voting scandals, do we really need to make the whole thing more difficult? No, of course we don’t. Email the Speaker of the House, the one who hasn’t been indicted yet, the Senate President and the Governor and tell them to get off their ass and protect the right to vote. A *please* and *thank you* might help. Ya never know.

China's Labor Laws: The Cultural Disconnect Goes Both Ways.
2009-04-06 03:25:00 Last week, I attended co-blogger Steve Dickinson's lecture on China labor law. Steve's lecture was part of a truly superb Doing Business in China seminar put on by Global Nav. The thrust of Steve's speech was that labor laws in China have changed, they are being enforced against foreigners, and they are very different from U.S. labor laws. In a nutshell, the biggest differences are that written contracts with all employees are required in China and firing an employee generally must be for cause. Neither of these are true in the United States. Judging from the audience questions (and this was an extremely sophisticated audience), many were surprised by this and many had trouble understanding the full import. A few days later, Steve and I were talking about this with the Chinese lawyers we work with in Qingdao. In explaining to them some of the cases we have handled for American clients who got themselves into trouble by improperly laying off Chinese employees, it soon bec...

China's Labor Laws. Worry Me Or Worry Me Not.
2009-01-11 06:08:00 About a month ago, we did a post entitled, "China's New Labor Contract Law. Harmonized Out Of Existence?" In that post, we (I say we here because some of what I was reporting was coming to me from co-blogger Steve Dickinson who is based in China) talked about how local and provincial authorities were giving out broad hints that they were not going to be all that keen about strictly enforcing China's labor laws other than those related to preventing layoffs: We have talked so much about the labor law because it applies to every business in China with an employee. Complying with the law is relatively easy and the penalties for failing to comply can be so harsh. But last week, a long-time client of ours with a factory in Shandong Province (just outside Qingdao) told me of how a Chinese government employee had essentially told him not to worry so much about China's labor contract law. The gist of the government employee's statements to our client was that so long as this company ...

Come on, in-laws!
2009-01-06 15:25:00 We take a "big" vacation about every other year -- go out of state and spend a week or so seeing the sites of some city. We do it every other year because it takes a while to save up the money and to find something that we all agree on. Since we went to Florida in 2008, we'd usually wait until 2010 to do another big vacation. But I'm thinking we might be able to swing vacation in 2009, too -- because I've been looking at vacationing in Branson, Missouri. My in-laws went there a year ago, and I was surprised. The only thing I remember about Missouri is when we went there as a family when I was about 7, to visit my aunt and see the St. Louis arch. But the arch, and my aunt, have nothing to do with Branson, and my in-laws were trying to prove to me that Branson is more than just country music. So they showed me the site for two of the hotels. The first one was the Hilton Promenade at Branson Landing. Fancy name, right? It's a fancy hotel, too. Check it out:But it's surprisin...

There Are The Laws When Times Are Good And There Are The Laws When Times Ar
2008-12-20 02:13:00 One of the things I love about being an international lawyer is using outside events to interpret the law. Now I know this is going to anger a lot of people, but non-lawyers generally do a terrible job interpreting the law. This is true worldwide. Examples of this abound: Non-lawyers tend to look for "the law" that applies to their situation. Once they have found that law, they think they are done. What they so often fail to do is put the law into context. Many years ago, we had a fairly client [I am going to get intentionally vague here] who was doing a big project in a foreign country. The client had read that companies in this country for less than six months did not need to pay a particular tax and they did not pay this particular tax. They had failed to read that this law (and a whole slew of other laws) did not applly to companies employing more than 50 people and this failure ended up costing them hundreds of thousands of dollars in penalties and attorneys' fees. ...

Senseless and Complacent - Domestic Violence Laws
2008-12-19 14:36:00 Denise and Louisa at ChristmasBarbara's Tchatzkahs called my attention to yet another example of a complacent attitude towards victims of attack, and then another senseless attack on another family member. Domestic Violence laws are to protect, and they seem to do the opposite at times. Most of the time domestic violence is a misdemeanor, but when a family member was attacked instead of the partner of domestic violence perp? Its attempted murder - which isn't a misdemeanor. Does that make any sense at all? The xgirlfriend was attacked with a hammer, and was classfied as a misdemeanor. The sister was shot in the face - that wasn't ... it was attempted murder. I don't know about you but if someone came towards me and hurt me with a hammer - I would assume it was kill! China's 10 Worst Laws
2008-08-19 18:01:00 Foreign Policy Magazine is out with a fascinating and very well done list of China's 10 worst laws (damn, why didn't I think of that). (h/t to Jeremiah over at Peking Duck) I certainly agree with most of those on the list, but I hardly think it fair to put the New Property Rights Law on there. Here's what Foreign Policy has to say about it: What it says: A first, this law granted the right to property ownership by private persons. What it does: Although one can own buildings and fixtures on land, the land itself still belongs to the state. The Chinese government also has a right to seize private property for “a public purpose,” a vague standard that is often exploited by commercial interests. The state must “provide compensation” for such seizures, but it usually offers a menial amount. Some analysts think that giving peasants in particular the right to sell their land would have tamped down rural unrest and helped millions find work and overcome poverty, but such ...

Students filing complaints against professors and trying to get them fired for political reasons. A list of subjects that university professors are not allowed to discuss (WTH?)Threats of "quotas" for hiring conservative professors and threats of money cutoffs if quotas are not met. Professors quitting their jobs and living in fear. Whew. Jesus Christ man.By the way, Jewish Zionist ultra-sleazeballs David Horowitz and Daniel Pipes have been behind a lot of this shit. And US Jews have been behind some of the worst examples of academic censorship and retaliation seen in recent days - the refusal of Yale to hire Juan Cole, and refusal of De Paul University to give the excellent scholar Norman Finkelstein tenure, followed by a monetary settlement and his subsequent resignation.
