2012-05-10 01:10:00 Martha Hart filed an updated lawsuit against Vince and Linda McMahon and WWE in the ongoing battle over WWE's usage of Owen Hart's name and likeness. The new claims include: *Owen's name would have reverted back to strictly his usage after his passing. *That Owen's legal name is not a "ring name" and therefore WWE does not have the rights to use, market and promote that name in their materials and DVD releases. *That WWE released eight DVDs and other items (including the WWE Encylopedia) without proper payments to Owen Hart's estate per his contract with Titan Sports, which required that royalty payments continue after his death. *WWE used original intellectual property such as family photos without the estate's permission. *That the Owen Hart Foundation has been hurt its unwanted association with WWE through their usage of Owen Hart video and material. Linda McMahon filed a motion on May 2nd asking for more time to respond to the updated complaint. There was a sett...

RICK ROSS WINS LAWSUIT
2012-03-30 15:35:00 Per TMZ.com Rapper Rick Ross can keep his name, thanks to an L.A. County Superior Court judge who shut down a bid from former drug dealer "Freeway" Rick Ross who tried to hoard the name. "Freeway" Rick Ross had filed suit against the rapper, claiming ownership of the name. In fact, the rapper has strongly intimated in his songs his name was inspired by the drug dude. In the song "Hustlin" for example, Ross makes several references to large-scale drug dealing -- despite what Freeway says ... the rapper never dealt drugs in his life. But the judge today ruled "Freeway" Rick has no case, and threw the lawsuit out. source

2012-01-09 06:57:00 The patent wars are heating up in every major software company around the world. A lot of companies are treading this path carefully. Online Payment Giant PayPal Files A Lawsuit Against Google Wallet
2011-10-03 10:19:00 Just last week, we reported that Google has come out with a NFC based mobile payment service, dubbed the Google Wallet. Google has been a frontrunner when it comes to using NFC for a variety of new and innovative applications. Google Wallet allows you to tap your NFC-enabled Android phone against a card reader and make payments. Now the online payment giant PayPal went on a rampage, filing a lawsuit against Google and two former PayPal executives who now work for Google. It accused the executives of ‘misappropriation of trade secrets’ and ‘breach of fiduciary duties’. Google had been negotiating with PayPal for over two years regarding online money transfer on mobile devices. Just before the deal was about to be signed, Google poached the PayPal executives, which led to PayPal filing a lawsuit. PayPal’s view on NFC is rather interesting because it doesn’t believe, unlike Google, that NFC will be of any use in the next three or four years. That ...

PMA Files Lawsuit Deeming Affiliate Law, HB 3569, Unconstitutional
2011-06-01 20:00:00 In March, you may recall that I wrote this Open Letter to Governor Quinn, asking him to veto HB 3569, which would allow the state to start collecting sales tax on internet purchases. It is against the Constitution of the United States (Commerce Clause of the United States Constitution, Art. I, Sec. 8, Cl. 3, and the federal Internet Tax Freedom Act) for states to collect internet sales tax if a company has no base in said state. Take for instance, one of the biggest hot topics of this debate, Amazon. Amazon has no home in Illinois. There are no warehouses here. The only Amazon presence in the state of Illinois comes in the form of affiliates, people like me,...

Slip & Fall Lawsuit Season
2010-12-27 15:32:00 Winter is here, and so is that ice that never seems to melt until sometime in April. Hopefully, you will make it through the season intact. Many, however, will slip and fall. Some will suffer serious injuries and decide to sue a neighbor, store owner, or management company for their damages (like medical bills, pain, and permanent harm). A common complaint is that our society is plagued with frivolous lawsuits over everything from hot coffee to falling tree branches. These cases get played up in the media. The truth is that you can't sue just because you got hurt. Correction: You CAN sue, but you won't win. And you'll have trouble finding a lawyer to take your case. At...
Facebook Faces Lawsuit For Patent Infringement
2010-11-26 06:45:00 Many of you may be wondering why we cover quite a large number of news stories on Facebook. We certainly cannot help in this regard given the fact that it is a global phenomenon today. And it’s the more the merrier proposition now. Businessweek reports that Facebook was sued for patent infringement by a person behind Priceline.com. And the person is none other than its co-founder Jay S. Walker, who also owned Walker Digital LLC, a Connecticut based company that develop, protect and commercialize intellectual property, which lost most of its stocks during the dotcom bubble crash. The company has filed a lawsuit against the social networking giant stating that it has misappropriated an invention that helps computers users establish anonymous communications. In the claim, Walker mentioned that three of his company’s employees invented a system that allows users to manage and control effectively the flow of personal information and Facebook violates that invention. There is specu...

eBay In A $3.8 Billion Lawsuit
2010-07-15 13:49:00 Everyone is familiar with the online auction giant eBay. It has often happened that a small time company sues a bigger company to hog the limelight and to get a piece of its earnings. This has precisely what has happened with eBay. A small company called XPRT Ventures has slammed eBay with a hefty $3.8 Billion over a claim that eBay had stolen XPRT’s previous patented technology, back in 2003. Supposedly, the technology in the online payment system that PayPal had introduced was shared confidentially by XPRT’s representatives. PayPal had incorporated that technology in an April 2003 patent called “Method and System to Automate Payment for a Commerce Transaction”. If eBay is found to have violated the terms, then it has to pay upwards of $11.4 Billion in damages. eBay representatives, on the other hand, say that this claim is without merit and that they are looking into it. In fact, XPRT has claimed that eBay has infringed upon six patents that al...

Walsh Campaign Again Faces Lawsuit
2010-06-24 23:00:00 Former Campaign Manager Files Amended Complaint for Unpaid Services MORTON GROVE, IL -- This morning in the Circuit Court of Cook County, Keith Liscio, former Campaign Manager for 8th Congressional District Republican nominee Joe Walsh, filed an amended complaint against Walsh's campaign for unpaid campaign management services on behalf of his firm Patrickson-Hirsch Associates. Liscio originally brought suit against the campaign in January seeking payment of $20,000 in unpaid fees but that complaint was dismissed without prejudice last month on a pair of legal technicalities. Specifically, the judge in the case ruled that Liscio's complaint must explicitly state that Mr. Walsh and Mr. Liscio's agreement in the case was oral and that the complaint must list Liscio's campaign duties and...

Arizona, immigration and flawed ACLU lawsuit

Unfortunately, one of the plaintiffs raises a red herring in the suit, according to the Times:Ten individual plaintiffs have joined with the groups in suing. They range from two Jane Doe plaintiffs who say they lack convincing documents and could be psychologically hurt by a police stop, to Vicki Gaubeca, a naturalized citizen who lives in New Mexico, regularly travels to Arizona, and worries her state driver's license doesn't meet the stricter Arizona requirements. Another plaintiff, Arizona resident Jim Shee, who is of Spanish and Chinese descent, said he has been stopped twice over the past month by local...

Illinois Lawsuit Loan Sharks? Stop This Latest Trial Lawyer Bill
2010-04-13 00:37:00 From the U.S. Chamber Institute for Legal Reform... Illinois' reputation for lawsuit abuse hurts our jobs climate. The last thing we need are measures in Springfield that would encourage trial lawyers to file more lawsuits. So then why are our state legislators considering a law that would do just that? This wrongheaded bill (S.B. 3322) would legimitize a new "lawsuit lending" industry in Illinois -- creating new "lawsuit loan sharks" who loan money to help people file lawsuits. More Illinois lawsuits? That's the last thing we need. This bill has passed the Senate and is pending in the State House: click here to email your state representatives today to oppose the "Lawsuit Loan Shark" bill. A recent Harris survey of...
