The singer's lawyer, Alan Chinula, confirmed that Madge was not granted custody of 3-year-old Chifundo "Mercy" James and refused to discuss the ruling further. Madonna, who was not in court, can appeal to the Supreme Court. A judge and another lawyer who saw the ruling, but where not associated with the case, told the Associated Press that Madonna was denied because of residency rules. Malawi adoption regulations require that prospective parents live in the southern African nation for at least 18 months. However, the residency rule was waived in 2006 when Madonna was allowed to take her adopted son, David Banda, to London before his adoption was finalized in 2008.
