She is also tacking on 7% because he said he was not sent a statement as to interest on security and where it is. 2012-05-04 01:22:00 I just sent out rent increase letters ($25 each unit) and today is the second time this month that a T told me, "I don't have any money and I am using my security deposit as my last month's rent."...no 30 days notice. BTW, I am strict with my application process...credit-employment checks,etc. I wrote them both back and said that this is not allowed, that they still owe this month's rent and they both said, "we don't have it." One is moving out this weekend so I'll have time to paint but the security deposit won't cover my losses. In my state if you collect first and last month's rent you have to return the last month's rent on the one year anniversary. This scenario doesn't happen often to me but when it does, I get so mad. It's not worth it to start any legal proceedings. I just hope they leave the place super clean. Ugh! What do you do in this case?
